What is a lasting power of attorney
(LPA) and why do I need one?

An LPA allows you to nominate who you would want to deal with your assets or make health decisions on your behalf, if you are no longer able to do so.

LPAs are for everyone. Unfortunately there is no way to know when an accident or illness could immediately impact your ability to deal with your finances or your health. Having an LPA in place takes a huge pressure off of the shoulders of your close relatives in such an upsetting situation, allowing them to immediately speak to doctors, pay bills and make sure that everything can be properly managed.

If you were to lose capacity for any reason without have an LPA in place, it may be necessary for someone to apply to Court to manage your affairs, which can be expensive and time consuming at a time when delay and stress would be ideally avoided.

Did you know that, without an LPA, it is not possible for your spouse to act on your behalf if you were to lose capacity, even temporarily? They may no longer have access to the bank account to pay bills, your income to continue providing for the family or even your advisors whose duties of confidentiality will seem like barriers.
